mitigation-of-damages doctrine legal definition

noun

The doctrine that requires a plaintiff to use reasonable efforts to alleviate the injury caused by the defendant. For example, a merchant who fails to receive goods due to the manufacturerÂ’s breach is expected to replace those goods with similar ones from another source, and will then be able to sue only for the difference in price between the contracted-for goods and the ones actually purchased.
